Welcome to Primakids. These Terms & Conditions (“Terms”) govern your access to and use of the Primakids website, platform, educational content, games, learning resources, subscriptions, affiliate programme and related services available through primakids.in (“Website” or “Services”).

By accessing, registering for, or using Primakids, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website or Services.

1. About Primakids

Primakids is an online educational platform providing learning resources, educational activities, quizzes, games, practice activities and other digital educational content primarily designed to support children and their parents/guardians.

Primakids may introduce, modify, improve, suspend or discontinue particular features or Services from time to time.

2. Parents, Guardians and Children

Primakids is designed to support children’s learning. Where a child uses Primakids, the parent or lawful guardian is responsible for supervising the child’s use of the platform and for ensuring that the Services are used appropriately.

Where applicable under Indian law, Primakids may require appropriate parental or lawful-guardian consent before processing personal data relating to a child.

Parents and guardians are responsible for reviewing the Services and deciding whether particular content or activities are suitable for their child.

3. User Accounts

Certain features require registration and creation of an account.

You agree to:

  • Provide accurate and current information.

  • Keep your login credentials confidential.

  • Not allow unauthorised persons to use your account.

  • Notify Primakids if you believe your account has been compromised.

  • Use your account only for lawful purposes.

Primakids may suspend or terminate an account if we reasonably believe that the account is being misused, shared, involved in fraudulent activity, or used in violation of these Terms.

4. Account Sharing

A Primakids subscription is intended for the individual user/student for whom the subscription was purchased.

Sharing, selling, lending, transferring or providing subscription access to another person is prohibited.

This includes sharing usernames, passwords, access links or other credentials with friends, relatives, students or other third parties for the purpose of providing them access to paid Services without authorisation.

Primakids may restrict or suspend an account where unauthorised account sharing is detected.

5. Subscription

Primakids currently offers an annual subscription at:

₹990 per year

The subscription provides access to the features and content included in the selected subscription plan.

Subscription benefits, available content and features may change from time to time.

Unless a different arrangement is expressly stated at the time of purchase, the subscription provides access for the stated subscription period beginning from activation.

6. Payment

Payments may be processed through third-party payment service providers.

You agree to provide accurate payment and billing information where required.

Primakids may delay or restrict access where a payment is unsuccessful, reversed, disputed, fraudulent or otherwise not successfully received.

Payment processing may also be subject to the terms and policies of the relevant payment service provider.

7. Refund and Cancellation

All subscriptions are non-refundable after subscription activation.

Once a subscription has been activated and access to the paid Services has been provided, the subscription amount of ₹990 is not refundable, including where a user:

  • Changes their mind;

  • Does not use the Services;

  • Uses the Services less frequently than expected;

  • Stops using the account;

  • Does not complete available lessons or activities;

  • Experiences a personal change in circumstances; or

  • Requests cancellation after activation.

Nothing in this section is intended to exclude or restrict any consumer right or remedy that cannot lawfully be excluded under applicable law.

8. Educational Content and Results

Primakids provides educational resources intended to support learning and practice.

Primakids does not guarantee any particular academic result, examination result, school grade, rank, competition position or learning outcome.

A child’s learning progress may depend on many factors, including participation, practice, age, educational background, parental support, school instruction and individual learning ability.

9. Games, Scores and Rankings

Primakids may provide educational games, practice activities, challenges, competitions, scores, leaderboards and rankings.

Users must participate fairly.

Users must not:

  • Manipulate scores;

  • Exploit technical errors or bugs;

  • Use automated tools or bots;

  • Attempt to interfere with another user’s account;

  • Use unauthorised methods to obtain an advantage; or

  • Otherwise engage in dishonest or abusive activity.

Primakids may remove or modify scores, rankings or competition results where we reasonably believe that manipulation, cheating or technical irregularities have occurred.

Primakids may change or discontinue any game, competition, leaderboard or ranking feature.

10. Intellectual Property

All original content available through Primakids, including but not limited to:

  • Lessons;

  • Educational materials;

  • PDFs;

  • Worksheets;

  • Questions;

  • Quizzes;

  • Games;

  • Graphics;

  • Illustrations;

  • Videos;

  • Audio;

  • Logos;

  • Branding;

  • Website design;

  • Software;

  • Text;

  • Images; and

  • Other digital materials

is owned by or licensed to Primakids unless otherwise stated.

Your subscription gives you a limited, personal and non-transferable right to access the Services. It does not transfer ownership of Primakids content to you.

You must not copy, reproduce, publish, distribute, resell, rent, commercially exploit, upload elsewhere, modify for redistribution, or create unauthorised derivative works from Primakids content without prior written permission.

11. Prohibited Activities

You must not use Primakids to:

  • Break applicable laws;

  • Attempt to gain unauthorised access to the Website or its systems;

  • Introduce malicious software or harmful code;

  • Interfere with Website security;

  • Scrape or systematically copy protected content;

  • Circumvent subscription restrictions;

  • Share paid access without permission;

  • Commit payment or subscription fraud;

  • Manipulate scores or rankings;

  • Abuse the affiliate programme;

  • Impersonate another person; or

  • Misuse the Services in a manner that may harm Primakids or other users.

12. Affiliate Programme

Primakids may operate an affiliate programme through which eligible affiliates can receive commissions for qualifying student subscriptions referred through their authorised affiliate links or methods.

The current commission is:

₹200 per eligible student

The minimum payout threshold is:

₹1,000

Commissions may be subject to verification before becoming payable.

Self-referrals are prohibited. An affiliate must not purchase a subscription through their own affiliate link for the purpose of generating a commission.

Primakids may reject, reverse or withhold commissions arising from:

  • Self-referrals;

  • Fraudulent transactions;

  • Cancelled or refunded transactions;

  • Duplicate or manipulated referrals;

  • Misleading marketing;

  • Unauthorised promotional methods;

  • Abuse of the affiliate system; or

  • Other violations of the affiliate programme rules.

Primakids may suspend or terminate an affiliate account where misuse or violation of the programme rules is identified.

Additional affiliate programme rules may be communicated separately and will form part of the affiliate relationship.

13. User Feedback

If you voluntarily provide suggestions, feedback, ideas or comments about Primakids, you agree that Primakids may use such feedback to improve its Services without creating an obligation to compensate you, unless otherwise agreed in writing.

14. Third-Party Services

Primakids may use third-party services such as payment processors, hosting providers, analytics providers, communication services and other technology providers.

Third-party services may operate under their own terms and privacy policies.

Primakids is not responsible for independent services, policies or actions of third-party providers except to the extent required by applicable law.

15. Website Availability

We aim to keep Primakids available and functioning reliably. However, temporary interruptions may occur due to:

  • Maintenance;

  • Technical failures;

  • Hosting problems;

  • Internet or network issues;

  • Security incidents;

  • Updates;

  • Third-party service interruptions; or

  • Circumstances beyond our reasonable control.

Primakids does not guarantee uninterrupted or error-free availability at all times.

16. Suspension and Termination

Primakids may suspend or terminate access to an account where we reasonably believe that the user has:

  • Violated these Terms;

  • Engaged in fraud or abuse;

  • Shared an account improperly;

  • Attempted to compromise the Website;

  • Misused the affiliate programme;

  • Engaged in unlawful activity; or

  • Otherwise used the Services in a manner that may harm Primakids or others.

Termination or suspension does not remove any rights or obligations that accrued before termination.

17. Privacy

Your use of Primakids is also subject to our Privacy Policy, which explains how personal information is collected, used, stored, protected and handled.

18. Changes to These Terms

Primakids may update these Terms from time to time.

When material changes are made, Primakids may provide appropriate notice through the Website, email or other reasonable means.

Your continued use of the Services after the updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by law.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Primakids shall not be responsible for losses arising from misuse of the Services, unauthorised account sharing, user-provided information that is inaccurate, third-party service failures, temporary technical interruptions or circumstances beyond Primakids’ reasonable control.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

20. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims or reasonable expenses arising from your unlawful use of the Services, violation of these Terms, misuse of your account or infringement of another person’s rights.

21. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.

Subject to applicable law, disputes relating to the Services shall be subject to the jurisdiction of the competent courts at Kodala, Odisha – 761032.

Nothing in this section is intended to deprive a consumer of any mandatory legal right or jurisdiction available under applicable law.
